He doesn't believe that. He knows he was committing crimes by doing so and is trying to build the "I didn't know any better, your Honor" defense.

He tried comparing his actions to authorities going after Al Capone for taxes... difference being; Al Capone was caught for laws he actually violated (didn't pay those taxes), but Joe is falsely claiming DMCA (the images don't belong to him)
