Wouldn't the Picture of Patso on TV be fair game for "fair use?"

Someone else posted this link in another thread, but
According to http://www.aaronkellylaw.com/consequences-of-filing-a-false-dmca-takedown-request/ Michael Crook, a controversial public speaker, was at the center of a DMCA takedown lawsuit. Apparently, after a TV appearance on Fox, 10 Zen Monkeys posted a criticism of him online, which included a thumbnail picture. So, Crook sued for copyright infringement. But he lost as it was "fair use".

Patso doesn't have the rights to that screengrab. Wouldn't that make it fair use or game for parody?

It's a matter of principle. Perhaps when Patso gets his picture taken at the next event, we could purchase the rights to it. I know a guy who would submit his personal information if Patso violates the law by filing a false DMCA takedown request. Patso would end up in jail.

Screw it, I'd donate to a gofundme for Brother Joe to do it if it meant Patso going to jail for breaking the law.
