Nah, technically speaking, the person who takes a photograph owns that photograph in the absence of any other legally binding agreement.
It's a good thing that kind of thing is easily enforced on the internet, history has shown that if you tell people not to use a picture for something, they will absolutely stop. This has proven effective 100% of the time.
I was under the impression that if uploaded to the internet it was fair game and if they wanted to pursue it legally they needed to have it copyrighted.
Nope, all you have to do is file a DMCA. Pretty much ever site honors them, so pursuing legal action would actually fall on the person using it. You'd have to bring it to court to argue that the image was fair use.
Hey, if this guy wants to hang out on our subreddit all day looking for shit to file DCMA's on, more power to him. He'll grow sick of it soon enough. Fatrick was doing the same thing with screenshots people took of his instagram, filing DMCA takedown requests. It took him all but a few days to pull the plug on that, that's a time-consuming game of whack-a-mole.
