A photo on the internet, in legal terms, cannot not have an owner. Someone is responsible for every photo on the internet in technical legal terms, although that's damn near impossible to prove in a lot of cases. But in this particular case the photo is of him, taken by him, which makes him 100% copyright owner of the photo. The fact that the photo's first appearance on the internet was on his personal instagram page also helps his case that the photo is his. So in legal terms, the photo is his and he gets to decide what's done with it.
On the other hand, if someone were to post a picture of him in public, he would be wrong to file a DMCA claim because the picture would belong to whomever originally took it and posted it. Plus there's no expectation of privacy in public either, so the photo would be completely legal to take.
If you can't tell, I've done a lot of reading over the past few months concerning this stuff. As someone already said, some of you are just hopping back into the Fatrick fun, and some of us never left.
