The bar only lost the case on a technicality. The contract he signed stated that he was allowed to cancel the band's appearance as long as it was longer than two weeks before the scheduled show, which it was...but it also said that the cancellation notice had to be sent via email, which he didnt do. Instead, he telephoned Joe to let him know. A lot of people, maybe most, wouldnt have the nerve to call someone up and give them bad news. Most people would have texted or emailed. The bar owner just didnt want to let fire Joe in such an impersonal way, so he called him up to speak to him man to man. If he'd have just sent him an email, he would have fulfilled all the stipulations of the contract and would have won. So basically he lost because he was trying to be a stand up guy.

If it is specified "by mail," that just means that it has to be in the mail by the date specified. It doesn't mean that Joe has to have opened the letter by the date - legally, as soon as a letter is mailed, it is the property of the recipient, and therefore any information contained in the letter is considered to be communicated upon the date the letter was sent, not when the letter was received.

I'm sure that Joe would've specified "by mail" to give himself more leeway and make it harder to cancel his gigs, though, because there is no way he would have done the research to know that.
