If convicted even for misdemeanor domestic he loses them. Here's some info on that law. Only chance is to be either found not guilty in trial or plea to simple assault, etc., not under domestic category.
If he's convicted of a felony or a misdemeanor crime of domestic violence then yes. Hopefully that doesn't happen and his lawyer is able to work a deal but honestly it doesn't look good. If he fractured her rib...well, that doesn't bode well for his case.

In Arizona at least. Any call for domestic violence, even if the cops leave without any charges can result in confiscation. And Arizona is as loose as Fez's asshole, so I can't imagine how NY feels about it.
