It should happen way before closing. That's what the Title Search is all about. At that point, the purchaser can walk away if the liens were not disclosed in advance.

Just handled a sale where the DOB placed a $5k fine against a building for not having a valid egress plan approved by the Fire Dept.
It had to be settled before the sale could be finalized.
