The worst part is, rumor has it that folks are using this persons' YouTube channel (https://www.youtube.com/user/crschmidt/featured) and also his personal site, (http://crschmidt.net/), to lash out and vent their frustration over this upstanding gentleman's decision.

The nice things about TACS in this regard are that it isn't served from Youtube and that nearly everything is behind the subscriber curtain. Anthony's content isn't being continually scanned by an automated system looking for "infringement", so it'd take an actual person to notice a potential issue and send a DMCA takedown letter.

Whether it is a third party claim or Youtube's content ID system, it seems like it would fall under fair use and is not protected.

Fair use is a very broad category. If you're using it for parody, education, criticism etc. - all of that falls under fair use. Having items be unprotected is essential to the spread and improvement of knowledge/ideas.

Of course JRE or TACS is parody/criticism. They are similar to Tosh.0 - and able to use the clips.

While one could argue that JRE and TACS use the clips to profit, the use is super limited and would fall under the scope of fair use. Kimmel, Fallon, Tosh etc. all do the same, with no fear of copyright claims.

I really hate the arbitrary copyright claims that YT and other sites allow to exist without any thought of fair use. It's lazy and intellectually dishonest.

I was really disappointed with Ant's appearance on JRE. They didn't really dive too deeply into anything, and Anthony had his "completely agreeable guy" persona up the whole time, so it was a lot of Rogan going over the same talking points he has hundreds of times.
