Why is a drunk guy allowed to concealed carry?

He didn't pull his gun because he knew his life wasn't in danger, stop trying to make this more of an issue.

He'd also need to show that he was facing deadly force to have used the gun - I don't think a girl hitting you a few times would qualify.

There are laws about where and when you can and can't carry. I'm not familiar with the NYC law, but in FL you can't carry in a bar.

Assuming he was drunk is wrong. Ant has shown repeatedly that he knows NY gun laws. As difficult as it is to obtain a concealed carry permit in NYC, I doubt he'd do anything that would jeopardize it.

Oddly enough sometimes the states where it is hard to get a permit have the loosest laws about carry once you have one. You can apparently carry in restaurants that serve alcohol in NY, and I see no laws about carry while intoxicated. www.handgunlaw.us/states/newyork.pdf

Pennsylvania is another state where carry while intoxicated is legal. The whole north east has some pretty gun friendly laws from back in the day when gun control wasn't so popular. They mostly just made it harder and harder to get permits, and since mostly law enforcement, politicians, and judges are the ones with permits, they figured keeping the loose carry laws was ok.

Same here in FL. Perfectly fine to carry in a restaurant that serves, but not in bars. I believe that even in the same establishment (like a TGIFridays), you can be in the restaurant, but not the bar section.

I wouldn't be surprised if there were laws about carrying while intoxicated, so it's probably a lot like drunk driving.

Did a quick search - it looks like it depends on jurisdiction; some specify that you cannot carry while intoxicated (didn't see anything specific to NY in that regard, which may indicate that it's not specifically prohibited there).
