  • Sirius dumped Anthony suspiciously fast considering how the controversy had mostly already reached its apex and was headed into a busy Fourth of July Weekend. Depending on what's been going on behind the scenes with management, a good case might be made that Ant got Benghazi'd and the tweets were just their way of finally bringing the axe down.

  • In rather simple terms, Sirius' press release states that they in no way support any kind of racially charged or "abhorrent" hate speech, despite the fact that, love it or hate it, Anthony has been using this exact kind of language for almost a decade on satellite radio. Like with Imus, if their contract is worded in a way that explicitly states that they've been hired to say controversial and shocking things, the language of the initial contract will always prevail over the press release (and in this instance, breaking any sort of moral clause would be extremely hard to prove given that they break it in a similar way just about every weekday on air).

  • From what I can remember about it being discussed on the show earlier this year, OandA are contractually bound to do the show with one another, and breaking that partnership is effectively breaking the show itself. Any wrongful termination of Ant will probably also be reciprocated with the show too.

  • Don Imus was able to successfully settle for breach of contract with much less evidence to work with, so unless Sirius specifically worded their contracts to avoid that kind of settlement, I'd say that OandA will have a pretty hefty case against Sirius for wrongful termination.

BONUS: And despite Howard's probable personal satisfaction in seeing both Anthony and OandA leave Sirius, the way in which it's happened definitely might send a "chilling effect" through the Stern studio. If he, as a broadcaster, comes out and makes an official statement that what Sirius did was wrong and could even potentially be the cause of the downfall of his own show one day, then Sirius investors might start to get spooked that their investment with the company is now being dictated by the whim of social media. Talk and entertainment radio is still the number one differentiating draw for Sirius, and spooking the top talent to other truly uncensored platforms would have a hugely negative impact on the overall stock price.

Your first point is probably correct. The fact that he was fired so quickly indicates that this isn't a snap decision on the part of Sirius. It has been a long time coming.

Which means the lawyers and suits over at Sirius have looked at the contracts very carefully and were confident that they could do this without exposing the company to further liability.

They could have just as easily suspended him for a month until the controversy blew over and then declined to renew the contract in a few months when it is up, but they didn't. They fired, fired, fired him. I suspect if there's a wrongful termination suit, all the financial benefit will go to Ant's lawyers.

As for the stock price and the future of Sirius? I think the fact that there's only one company left (out of two) doing satellite radio speaks for itself.

The wording of the press release is irrelevant. In order to win a case or force a settlement, Cumia would have to show that SiriusXM violated the terms of their agreement when they fired him.

Again, the fact that they did so quickly indicates to me that they've probably done their due diligence. And though his Twitter is now empty, nowhere in his angry rants did Ant say anything about being wrongfully terminated.

Maybe if XM had acquired Sirius instead of the other way around. Sirius as a company hitched its wagon to Howard 100%, and Howard has no reason to be fearful of them.

I see what you're saying in theory, but I don't see it in practice. Howard is above the corporate policies at Sirius. If he breaks a policy then the policies will change with Howard now being on the right side. I think O&A would say as much...they were kings at XM, but were never held in that regard after the merger. Howard is the man there. They're not on equal playing fields.

If they take Anthony back they're dealing with lost sponsors on every station. Sharpton, etc. never had to rally the troops here because SXM acted quickly, but I have no doubt that every black leader would be out for blood if they rehired Anthony.

If they somehow agreed to get paid to not compete for a long period of time again, that's a great way to permanently alienate their fans.

It's not like they have a lot of great options. But I think you're right. These long breaks are devastating to the fanbase numburzzzzz.

If that was true, this sub wouldn't be littered with people either never subscribing to SXM or canceling their subscriptions almost as quickly as Ant got fired. Mostly the former - the show isn't free, and listening without subscribing sends a signal that listeners don't really care. I know we're not all multi-multimillionaires, but $80 a year for a near daily show isn't so bad.

But as of the mass exodus of subscribers yesterday, SXM has little incentive to keep them around, especially if they feel they can survive or are better off without the b-b-b-boys' fans (and they may be). It's also been pointed out in other places, but this could end up in a weird place because only Ant was let go, but there may be a clause somewhere that they have to do the show together. If Opie isn't also release (doubtful), then it's effectively the end of the show. The whole thing stinks.
