I believe it was scorned former producer Ben Sparks who claimed he had the sex tape. Opie and his wife filed a suit against Chaunce Hayden for reporting that the tape existed, but the lawsuit was thrown out because he only reported what he had been told.
Ironically O&A had scorned former Stern show associate Crazy Cabbie on the air not too long before to claim that he had a Howard Stern sex tape and describe it, but when Chaunce Hayden did the same thing Opie sued him and the Post for $10 million.
