So Jim really just gets to keep $60k? No consequences for not following through? Because a bunch of people payed the idiot tax? Also to whoever donated, why??? Even if it was seen through to completion it would've been horrible...

No, Kickstarter pretty explicitly says that your donations aren’t contingent on anything, and I’ve never heard of anyone successfully suing to get their money back.
Jimmy absolutely DOES owe income tax on that $60k though. Unlike Joe’s allowance, it can’t be classified as a gift (which Joe unfortunately wouldn’t pay taxes on).

Currently, no. Both Kickstarter and Indigogo both try to walk the line between buying a product, and donating to somebody. They need to get people to feel like they're buying a product to bring the money in; but they also need fine-print to ensure that they don't get sued for non-delivery of goods, or for fake claims, or for not vetting their vendors. Basically, they want to have their cake and eat it too.
This will continue until enough people get scammed that the Federal Government steps in to regulate them - which is the same thing that happened with stock exchanges, banks, insurance companies etc.

KS makes it clear you're being presented an offer as an "investor" and not buying a product, which is all they need to do to cover their asses. They don't have to make sure there's even an attempt to deliver, as long as they warn you there's a risk and get their cut, it's not their problem.
